More specifically, the government requests that Marino pay $8,960.00 for the government withheld 200,000 pages of DOCUMENTS, that may be responsive to Marino’s Freedom of Information Act/Privacy Act Requests numbers: 11-2085, 11-2968, 11-2969, 11-3089.
Specifically concerning egregious governmental misconduct & Marino’s actual, factual & legal innocence of the June 16th, 1989 Salemme attempted murder, & the governmental misconduct in that charge: predicate Racketeering Act A-2 depicted in Count One RICO & Count Two RICO conspiracy charged against Marino & NOW Ponzo. See United States v. Marino, CR-97-40009-NMG. (District of Massachusetts/Boston/Worcester).
Also see United States v. Ponzo, Criminal Number: S-97-40009-NMG. (District of Massachusetts/Boston) Superseding Indictment, which ONLY depicts RICO conspiracy charges against Ponzo, as Count One RICO against Marino was clearly & concededly DEFECTIVE in the First Indictment April 4th, 1997.
Hence, Marino’s Count One RICO conviction & sentence should be dismissed with prejudice, because Count One RICO is defective and appears to be double jeopardy as Count One RICO contains the wording of Title 18 U.S.C. Sections 1962(c) & Title 18 U.S.C. Section 1962(d). As the PUBLIC RECORDS so supports.
