“Three Cons Seek FBI mob files in an effort to get a new trial”

A mafia triggerman from Longmeadow who is serving 33 years for killing William “The Wild Guy” Grasso, his hated Underboss, has asked a federal judge (Nevas, CT) for secret Boston FBI files in a bid for a new trial.Attorneys for Gaetano Milano and two others convicted of executing “The Wild Guy”: Grasso in 1989 argue Agents used Informants to stoke underworld violence leading Milano to kill in self-defense.According to a motion released yesterday, Milano, Frank Pugliano, Lous Pugliano, and Frank ColantoniI Jr., have asked United States District Court Chief Judge: Mark L. Wolf in Boston for the sealed documents.
The ex-mob foot soldiers hope some of the same documents that exposed the FBI‘s ties to criminal informants James “Whitey” Bulger and Stephen “The Rifleman” Flemmi will held their case.In Court papers, they argue mob turncoat Angelo “Sonny” Mercurio was working as an informant (TOP ECHELON FBI INFORMANT) while fomenting feuds in the New England mob and conspiring on the Grasso murder.But Mercurio ‘s informant status was never revealed to defense lawyers when Milano, Pugliano’s and Colantoni went on trial in 1990, according to the motion.The government WITHHELD evidence in pretrial and presentencing proceedings that would have been FAVORABLE to the petitioners,” attorneys for the men said in court papers.
During Judge: Mark L. Wolf’s 1998 (Salemme) hearings on the FBI and mob former Assistant United States Attorney (Chief of the New England Organized Crime Strike Force) Diane Kottmyer (NOW a Suffolk Superior Court Judge in Boston), testified the government knew Mercurio was part of the faction who plotted the Grasso murder.
The government also knew about the faction’s attempt to kill New England Mob boss Francis “Cadillac Frank” Salemme in 1989, she told the court.Connecticut United States District Court Judge Alan H. Nevas has given attorneys for Grasso’s killers permission to depose Kottmyer, who is now a superior court Judge.The judge also will allow attorneys to depose Mercurio who is in the Witness Protection Program.Judge Nevas ordered federal prosecutors to make him available, according to court records.etc….

Marino, CR-97-40009-NMG. (District of Massachusetts/Boston and Worcester) on December 22, 1999, Verdict Form, by a JURY TRIAL.
However the Court (Judge: Nathaniel M. Gorton, D.Mass) with the urging of the Government: Assistant United States Attorney’s: Auerhahn and Young dramatically enhanced Marino’s sentence an extra 25 years by the mere Preponderance of the evidence taking away Marino ‘s Jury Vverdict of NOT PROVEN BEYOND A REASONABLE Doubt violated Marino‘s due process of the Fifth Amendment and Sixth Amendment’s JURY TRIAL RIGHT.
Marino, has been systematically blocked by the district court Judge: Nathaniel M. Gorton, Two assistant United States Attorneys:Jeffrey Auerhahn and Cynthia Ann Young from seeking relief without any transparent corresponding accountability from the United States Department of Justice since 1989, over 25 years.
